End User License Agreement

IMPORTANT: Please read this End User License Agreement ("Agreement") carefully before installing or using ThreatLab. By installing, copying, or otherwise using ThreatLab, you agree to be bound by the terms of this Agreement. If you do not agree to these terms, do not install or use the Software.
1. Definitions
"Software" means the ThreatLab application, including all associated files, libraries, updates, patches, and documentation.
"Licensor" means BrightByte Labs LLC.
"Licensee" or "You" means the individual or entity that has purchased a license to use the Software.
"Seat" means one authorized installation of the Software on a single machine.
"Subscription" means the active license period during which You are authorized to use the Software.
2. License Grant
Subject to the terms of this Agreement and payment of applicable fees, Licensor grants You a limited, non-exclusive, non-transferable, revocable license to:
- Install and use the Software on the number of machines corresponding to the Seats purchased under Your Subscription.
- Use the Software solely for its intended purpose of malware analysis, threat investigation, and security research within Your organization.
3. License Restrictions
You shall NOT:
- Copy, modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Software.
- Distribute, sublicense, lease, rent, sell, or otherwise transfer the Software or any rights therein to any third party.
- Remove, alter, or obscure any proprietary notices, labels, or marks on the Software.
- Use the Software to develop a competing product or service.
- Use the Software for any unlawful purpose, including but not limited to the creation, distribution, or deployment of malware, or any activity that violates applicable laws or regulations.
- Circumvent or attempt to circumvent any license verification, activation, or copy protection mechanisms in the Software.
- Share license keys, activation tokens, or account credentials with unauthorized parties.
- Exceed the number of Seats authorized under Your Subscription.
4. Subscription and Payment
- The Software is licensed on a subscription basis. Your right to use the Software is contingent upon maintaining an active Subscription.
- Upon expiration or termination of Your Subscription, Your license to use the Software terminates immediately.
- Licensor reserves the right to modify pricing and Subscription terms with reasonable notice.
5. Activation and Verification
- The Software requires online activation and periodic license validation. An internet connection is required for these functions.
- The Software collects a machine fingerprint (derived from hardware identifiers) solely for the purpose of license enforcement and seat management.
- The Software communicates with Licensor's servers for license validation, VPN session management, software updates, and AI-powered analysis features.
6. VPN Services
- The Software includes VPN routing through Licensor-operated servers for the purpose of anonymizing sandbox network traffic during malware analysis sessions.
- VPN services are provided "as-is" and are intended solely for use with the Software's analysis features.
- You shall not use the VPN services for any purpose other than malware analysis through the Software.
- Licensor does not guarantee the availability, speed, or geographic location of VPN endpoints.
7. AI-Powered Analysis
- The Software includes optional AI-powered threat analysis features that transmit aggregated session data to third-party AI services (currently Anthropic's Claude API).
- Only aggregated threat scores, event summaries, and session metadata are transmitted. Original files, personal data, customer information, and credentials are never transmitted.
- AI analysis features can be disabled in the Software's settings.
- Licensor is not responsible for the accuracy, completeness, or reliability of AI-generated analysis results. AI analysis is provided as a supplementary tool and should not be the sole basis for security decisions.
8. Data and Privacy
- Session data (recordings, screenshots, monitoring logs, reports) is stored locally on Your machine. Licensor does not access, collect, or store Your session data on its servers.
- Licensor collects and processes limited data as described in the Privacy Policy.
- You are solely responsible for the security of data generated by the Software on Your systems.
9. Intellectual Property
- The Software and all copies thereof are proprietary to Licensor and title thereto remains in Licensor.
- All rights in the Software not specifically granted in this Agreement are reserved to Licensor.
- The Software incorporates third-party open source components. Licenses for these components are available within the Software under Settings > Third Party Licenses.
10. Disclaimer of Warranties
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
THE SOFTWARE IS DESIGNED TO ANALYZE POTENTIALLY MALICIOUS FILES AND URLS. WHILE THE SOFTWARE EMPLOYS ISOLATION TECHNIQUES (VIRTUAL MACHINES, NETWORK ISOLATION, VPN ROUTING), LICENSOR DOES NOT GUARANTEE THAT MALWARE ANALYZED WITHIN THE SOFTWARE CANNOT AFFECT YOUR SYSTEM OR NETWORK.
11. Limitation of Liability
IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
LICENSOR'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SOFTWARE DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify, defend, and hold harmless Licensor from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from Your use of the Software, Your violation of this Agreement, or Your violation of any applicable law.
13. Termination
- This Agreement is effective until terminated. Licensor may terminate this Agreement immediately if You breach any of its terms.
- Upon termination, You must cease all use of the Software and destroy all copies in Your possession.
- Sections 9, 10, 11, 12, and 14 shall survive termination.
14. General
- This Agreement constitutes the entire agreement between You and Licensor regarding the Software and supersedes all prior agreements and understandings.
- This Agreement shall be governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law provisions.
- If any provision of this Agreement is held to be unenforceable, the remaining provisions shall remain in full force and effect.
- Licensor's failure to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.
